Terms of Service

1. Acceptance of Terms

By accessing or using the Cervantiq platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Cervantiq is a dental clinic management system that provides tools for appointment scheduling, patient records management, billing, treatment planning, and related clinical operations. The Service is intended for use by authorized clinic staff only.

3. User Accounts

  • Access is granted by invitation from a clinic administrator.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must notify the clinic administrator immediately of any unauthorized use of your account.
  • Sharing accounts or credentials with unauthorized persons is strictly prohibited.

4. Acceptable Use

You agree to:

  • Use the Service only for legitimate clinic operations.
  • Access only patient records necessary for your role and duties.
  • Comply with all applicable laws, including the Data Privacy Act of 2012 (RA 10173) and its Implementing Rules and Regulations.
  • Maintain the confidentiality of all patient information accessed through the Service.
  • Report any suspected data breaches or security incidents immediately.

You agree NOT to:

  • Access, copy, or export patient data for purposes unrelated to clinical care.
  • Attempt to circumvent access controls or security measures.
  • Share patient information with unauthorized third parties.
  • Use the Service to store or transmit malicious software.

5. Data Privacy & Confidentiality

The Service processes sensitive personal information and personal health information (PHI). All users are bound by the clinic's data privacy policies and applicable Philippine law. For details on how personal data is collected, used, and protected, see our Privacy Policy.

6. Intellectual Property

The Service, including its software, design, and documentation, is the property of the clinic and its licensors. You are granted a limited, non-transferable license to use the Service for its intended purpose during your authorized access period.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.

8. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

9. Termination

Your access may be terminated at any time by a clinic administrator. Upon termination, your right to access the Service ceases immediately. Obligations regarding data confidentiality survive termination.

10. Governing Law

These Terms are governed by the laws of the Republic of the Philippines. Any disputes shall be resolved in the courts of competent jurisdiction in the Philippines.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated to active users.
